The cost to purchase the contract is approx $250k. But as stated below. Tha amount decreases every pay period.

I was hoping to get a copy of the contract (hint hint SS) so I can scan and make available here on the fourm and my own website.

[Grammatical aside: Appy-polly-loggies for the split infinitive, but I wanted to emphasize the nature of the question being voted on. Is the split infinitive ok? I have tried to copy this over to the Grammar Issues thread so that this thread can stay on topic.]

So as expected, the 4Harding bunch ducked the vote, and instead voted to table the issue of Michael Harding's extension pending his evaluation, per the motion put forth by Jeff Jones. It passed with the same 4-3 vote as always. When asked by Jim Kintzele when the evaluation was planned for Jones responed by saying he was under the impression that the form was ready to go, and it could be done at anytime. They gave no commitment or timetable for it to be done.

Hopefully the other three members make a motion at every single meeting to re-visit a motion to bring the extension off of the table for a vote until the end of the year, or until that time in which they agree to a vote on the extension.

To be fair, Jeff Jones did actually revisit the Superintendent evaluation later in the meeting. He said be believes they should be able to do those evaluations by the second meeting in November. I am glad that they are going to move forward on this issue. I really hope the pressure stays on and it does not fade into the backround.

The pressure actually has to ratchet up on the Gang of Four to vote No on any extension. They actually have to vote to consider the question first, because they can vote to table and thereby extend.

Anything other than a No to Extension means Yes, whether it is to explicitly do so [dang split infinitive again!] or to table the matter.

MICHIGAN CITY - "It's Not Fair," a book read to Eastport Early Learning Center students in a presentation at Tuesday night's Michigan City Area Schools board meeting, ironically summed up the feelings of the audience present.

A standing-room only crowd of some 135 attendees were there to ultimately hear the School Board table a decision on extending Superintendent Michael Harding's contract.

Scattered boos were heard when Harding entered the room before the meeting.

School Board member Jim Kintzele said last week he wanted all board members to vote on the record about the contract since three members - Rick Carlson, Nate Gipson and Clyde Zeek - are seeking re-election Nov. 4.

Kintzele made a motion not to extend Harding's contract. The motion was met with loud cheers and clapping from the large audience. However, School Board member Jeff Jones moved to table the contract discussion until the superintendent evaluation is completed. The motion was seconded and resulted in a 4-3 vote in favor. The vote split along expected lines, with Jones, Kathryn Lee, Carlson and Gipson voting in favor of the motion and Kintzele, Zeek and Beryle Burgwald voting against it.

The decision prompted groans from the audience. Individuals shouted, "It's the taxpayer's business," "It's our kids" and "We want to teach."

Most of the crowd got up and left the room.

After the meeting, Phyllis Stark, Michigan City Education Association president, called the board's action unfair.

"We have not had a new contract and no pay increase," Stark said, "and they tabled his contract? What is the board trying to say to us?"

The MCAS teachers continue to operate under a contract that expired in June 2007. Recently, the school administration decided to move to fact-finding, which ended the mediation that was in process with the teachers' union.

"I think it's very clear that we didn't leave the table," Stark said. "We were so close to agreement. I just don't get it."

Harding didn't have much to worry about with the vote because his current contract extends to June 30, 2010. According to Indiana law, school systems are required to offer superintendents three-year contracts. If the board takes no action by the end of this year, Harding's contract will be good until June 30, 2011.

After the vote, Burgwald asked whether the evaluation was tabled indefinitely.

Jones said, "My feeling is, if we want to get this done, we can get it done quite quickly."

If the contract extension is put to another vote following Harding's evaluation, the board membership will be the same, since new terms don't begin until January, and would probably result in the same 4-3 vote in favor.

Shouts of "School Board note Nov. 4" during the meeting warned board members to expect changes in the board makeup following the election. But the new members would not join the board until Jan. 1, 2009, after the Hardingcontract issue was already decided.

Some who attended the School Board meeting waited for the public forum at the end. Bill Greene, a School Board candidate, said his children went to Michigan City schools "when they were good."

"It's sad when the leadership of our schools have lost respect from almost everyone in this room," Greene said. "On Nov. 4, people will speak out and change that 4 to 3 vote."

One woman, who said she was an Elston High School graduate, was concerned about the lack of teamwork among the board members.

Looking directly at Harding, she said, "You obviously have no respect for teachers and they have no respect for you. I challenge every citizen in Michigan City that on Election Day, let's make a change that's going to work."

A man in the audience thanked Kintzele for his motion on the contract and chastised the other members.

"Four board members employed the same delay tactics," he said. "Nov. 4 will be a watershed date for change."

The school board election Tuesday isn't going to immediately settle any of the issues tearing Michigan City Area Schools apart. Winners won't take office until January, so even if new members are elected, the big issues look as if they will remain smoldering for the foreseeable future.

Most prominent recently was the question of whether to extend the contract of Superintendent Michael Harding. This past week the school board split 4-3 to table that decision, in effect giving Harding an automatic one additional year on his contract, which now extends to June 30, 2010. The only way to prevent it from being extended to 2011 is if the current board revisits the question before the end of this year, then votes not to extend it, but that is unlikely, given a 4-3 split on the board favoring Harding.

Three incumbents are on the school board ballot this year. All three have competition on the ballot Tuesday. Five people are running for onw seat, four for another and three for the third. With the vote divided so many ways, and with most of the candidates being credible contenders, it's hard to predict what could happen.

Chances are, the board will remain split, even polarized as it is now.

While the superintendency of Harding is not the only yardstick by which to measure MCAS, he probably is the most polarizing figure in the MCAS.

He is key to settling the teacher's contract talks, which have dragged on more than a year. In that time, Harding has gained virtually the universal opposition of the district's teachers.

Similarly, the city is torn over the issue of whether school gymnasiums should be used the way the Parks Department wants to use them under a 20-year-old contract between parks and schools. Again, people who want to see things get done are left with a bitter taste in their mouths.

Harding isn't on the ballot Tuesday, but the election may be a referendum on him. We hope that something decisive comes from the vote, because the school system's issues have dragged on far too long.

The agenda is not available online yet. Normally, the agenda is available online thursday or Friday the week before the meeting.

I'm not ruling this out, in order to vote on Harding, they needed to do an evaluation on Harding and we just got this in the email about a special executive meeting being held Tuesday...is Harding the one under review?

And while previewing this post, I don't know why all those goofy smiley faces keep appearing, it's just a copy and paste job...

From Michigan City Area Schools Bylaws and Policies Website (NEOLA)

0166 Agenda

Only the Superintendent and Board members may place items on the agenda. Any Board member wanting to place an item on the agenda will submit such a request, in writing, to the President or Superintendent no later than the Monday, eight (8) days prior to the scheduled meeting.


Exceptions to the deadlines imposed in this Bylaw may be made when emergencies such as fires, robberies, and other problems affecting the safety of staff and/or children must be reported to the Board. The Superintendent and the President are authorized to make an exception to the deadlines established herein.


All items on the agenda requiring action will include a Statement of the Issue, Cost/Benefit Statement, Budget Impact, and Recommendation from the Administration. The administration may also present as needed statements of issues for information only which do not require action during the meeting but will be presented for action at a future meeting. The administration may place on the agenda for any meeting either items requiring action or statement of issues for information. Agenda items requested by the public will be identified by subject and by individual, association, or group making the presentation.


Any citizen, group of citizens, or associations or organizations desiring to address the Board in this manner must submit a written request to the Superintendent no later than 4:30 p.m. the Monday, eight (8) days prior to the Board meeting. Public agenda items will be placed in the Communications and Announcements segment of the Agenda (see order of business).


Those citizens who wish to address the Board but who have not asked to be placed on the agenda will be given an opportunity to do so during the open forum portion of the Board’s regularly scheduled business meeting. No open forum will be scheduled during the Board’s discussion meetings. All information presented during the open forum which warrants additional action will be referred to the Superintendent for disposition. The Superintendent's disposition may be delivered at his/her discretion by letter, direct contact, or by placing the subject on a later Board meeting agenda.


Prior to the meeting, a copy of the agenda shall be posted at the entrance to the meeting location.


The Board shall transact business according to the agenda prepared by the Superintendent and submitted to all Board members in advance of the meeting. The order of business may be suspended at any meeting by a majority vote of the members present.


The Superintendent has the discretion, after consultation with the President, to remove agenda items in the event the agenda becomes overcrowded. Board members, citizens, or organizations who have asked for agenda items will be notified prior to the scheduled meeting if the agenda item must be removed. Agenda items removed due to overcrowding will be placed on the agenda on the next regular business meeting or, at the discretion of the Superintendent, on the agenda of the next discussion meeting. Agenda items removed due to changes in information may be returned to the agenda when the Superintendent feels all necessary information has been gathered to provide a responsible public presentation.


The Board will follow the order of business established by the agenda except as it votes to rearrange the order for the convenience of visitors appearing before the Board or to expedite Board business. The President may choose, at his/her discretion, to recognize visitors at the time a particular matter is being discussed.


The Superintendent shall distribute the agenda to the place designated by each Board member on the Friday preceding the Tuesday of the regularly-scheduled Board meetings as well as all special meetings called by the Board. All communications received by the School Corporation which are addressed to the Board will be copied and distributed to all Board members either in the agenda packet or at the beginning of the meeting.


An agenda of all meetings shall be posted at the entrance of the facilities where the meeting will be held.

0167.3 - Public Participation at Board Meetings

In accordance with the Indiana Open Door Law (I.C. 5-14-1.5.5 et. seq.), all regular and special meetings of the Board will be open to the public.

Because the Board desires to hear the views of citizens and organizations who reside within the School Corporation boundaries, visitors will be recognized in the following manner:

A. When the citizen or organization has requested to be on the agenda. (see 0166)

B. During the Open Forum at the end of the meeting.
Rules to be followed by those addressing the Board are as follows:


A.
Each person must give his/her name and address when addressing the Board. Those persons or organizations that reside outside the School Corporation boundaries may be requested by the President to show a bona fide reason for addressing the Board
.

B.
Discussion of agenda items shall be limited to the Board, Superintendent, and those citizens recognized by the President. All visitors must address their comments or questions to the President. Other persons present may speak only in response to an inquiry from the President or Superintendent for the purpose of providing additional information or clarifying the subject being discussed.


C.
No person may present orally or discuss at any meeting of the Board any charges or complaints against individual employees of the School Corporation without first presenting such charges or complaints to the Board through the Superintendent, in writing, signed and verified by the person or group making the charge or complaint. (see policy 9130)


D.
Remarks by any person addressing the Board which reflect adversely upon the character or motives of any other person or group are out of order. Also attacks in form of inferences, insinuations, and innuendoes against the character or motives of any person are out of order.


E.
During the course of the meeting, the President may recognize persons in the audience who have something to contribute to the topic being discussed.


F.
The President may terminate any person's privilege of address for persistent violations of conduct by a participant repeatedly declared out of order for violations of the above rules.


G.
Under certain conditions, it will be the President's discretion to set time limits on public comments to the Board. This may be necessary due to a long agenda or a large number of persons requesting and having a valid reason to address the Board.


Comments made during a Special Meeting, must relate to the subject for which the meeting was called.
