LaPorte County Prosecutor Bob Szilagyi said evidence was still being reviewed to determine if charges will be filed and, if so, what the charges will be.

Under Indiana law, Szilagyi said defendants can be held for 48 hours and if no charges are filed by that time they must be released.

“We have 48 hours to decide what we're going to do,” said Szilagyi.

According to Long Beach police, officers after 7 p.m. Tuesday responded to the 2900 block of Lothair Way on a report of a woman being shot.

A female was found dead inside the residence along the Long Beach Country Club golf course.

Police said it appeared a domestic dispute had occurred but further details on what led up to the shooting were being withheld due to the ongoing investigation.

Authorities were also not releasing the name of the victim or her husband.

Szilagyi confirmed the victim and man being held were husband and wife.

He also revealed the case is being investigated as a homicide but an official ruling on cause of death had not yet been made.

“I don't want to say things on something that I don't have the complete information on yet,” said Szilagyi.

Neighbors expressed sadness and surprise at what occurred.

“It's just a horrible thing,” said Jane Scott, who lives across the street from the home where the shooting took place.

Scott said four children all under the age of 14 were living in the home.

She didn't know the family very well but did say hello to them whenever she saw them while checking her mail or doing something else outside.

“They seemed like normal people,” said Scott.

“They had four lovely kids,” said another neighbor, Richard Sweney, who was familiar enough with the family to know the couple's children on a first name basis.

“I went out to turn on my Christmas lights and saw the street was full of police cars,” said Sweney.

Sweney said fatal shootings are reported in the news from different areas of the country on a regular basis and to have someone shot to death so close to his home is disheartening.

“It's a bummer because we are in a nice neighborhood and then you have the same thing next door. It’s pretty awful,” said Sweney.

A fatal shooting Tuesday evening in Northwest Indiana has left one woman dead and her husband being held for questioning.

Through real estate records, Victims News Online has been able to confirm the name of the current homeowners, but at least one real estate source in the area has indicated the home may have been in the process of a sale.

The investigation is being conducted by the Long Beach Police Department, with assistance from neighboring Michigan City Police Department’s Detective Bureau.

LaPorte County Prosecuting Attorney Robert “Z” Szilagyi told Victims News Online that the MCPD’s assistance is routine with smaller departments such as Long Beach, and he hopes more information will be released about the situation tomorrow.

Police responded Tuesday night to the home in the 2900 block of Lothair Way on a report from an unknown caller of a woman being shot in the chest.

Szilagyi said the couple was having some marital issues and when John Larkin came home “there was a fight.”

Szilagyi said the case is still being investigated so it's possible the charge against Larkin could change depending on the discovery of any new findings.

Larkin could face a maximum 50 years on the current charge.

The couple had four children.

John Larkin ran for a seat on the Long Beach Town Council in 2011 but lost in a close race.

It sounds like the prosecutor does not understand the law. According to the prosecutor, he did not mean to kill her. "Szilagyi said the evidence indicates Larkin did not intend to kill her but did so “during sudden heat,” which under Indiana qualifies as voluntary manslaughter."

“Murder requires specific intent to kill. There's a very big difference,” said Szilagyi.


IC 35-42-1-3
Voluntary manslaughter
Sec. 3. (a) A person who knowingly or intentionally:
(1) kills another human being; or
(2) kills a fetus that has attained viability (as defined in IC 16-18-2-365);
while acting under sudden heat commits voluntary manslaughter, a Class B felony. However, the offense is a Class A felony if it is committed by means of a deadly weapon.
(cool.gif The existence of sudden heat is a mitigating factor that reduces what otherwise would be murder under section 1(1) of this chapter to voluntary manslaughter.

I don't get it. It says the gun went off "accidentally" yet reports suggest the victim was shot several times. So - the gun went off accidentally several times?

I searched this page for the word accident or accidentally and came up dry. Where does it say that?

I hope this case isn't screwed up by the county. The county prosecutor recently had his license to practice law reinstated. The state supreme court suspended him because he had forged his ex wife's signature to a deed.

To answer your question, reading this article it would appear that it might be an accident. If I had to give you a yes or no answer, due to the gravity of the situation, I would just simply say NO because it isn't clearly spelled out and I wouldn't allow ambiguity to skew my answer.

A couple of articles have referred to "multiple wounds." Is the coroner's report online anywhere? What is multiple, two or more? If there were more than two, Johnny's lawyer is going to have a tough time coming up wih a defense.

No idea where you got smart ass out of that. Yes, reading only this article does indicate it very well could have been an accident. But I know I've read reports that the wife died of multiple gunshot wounds. If so, there's no way this was an accident.

From the News Dispatch -

On Thursday, La Porte County Coroner John Sullivan ruled Stacey Larkin's manner of death was homicide as a result of multiple gunshot wounds.

In an above story it says -

Szilagyi said it appears Stacey Larkin retrieved a gun from a gun safe and John Larkin was trying to get the gun away from her when the firearm went off.

“That's the evidence we have at this point,” he said.

And how did they get that evidence? The guy that killed his wife told them that to save his ass? That scenario does not result in "multiple gunshot wounds".

I would guess the idea is that it was an accident in that he didn't intend to shoot her before she pulled the gun or her, or even when the first bullet was discharged. But after that happened, adrenaline took over?

It started of as an accident, but didn't end that way?

Obviously I don't know what happened, but it is a reasonable theory in my mind.

I would think if it really was an accident after the gun went off he'd have dropped it and tried to save her life. To keep firing rounds into her... of course, none of us can know. But multiple shots sure seems to indicate something more than an accident.

Johnny pled not guilty, and he is allowed to travel to both Michigan and Illinois.

I would be willing to bet almost anything it wasn't a fully automatic weapon. Those are very, very, rare and if you don't have the right tax stamp, very, very illegal.

I am surprised that John did not claim that he "worked" in Argentina. The "prosecutor" probably would have agreed to let him continue his work there. I wonder how many people will want to buy any real estate from him in Indiana, Michigan or Illinois.

This whole thing stinks to high heaven to me.

Multiple gunshot wounds to the chest... the wife dies... the husband who did it is put into a "mental health cell" at the county jail... is let out less than 72 hrs later... even before the wife is laid to rest... family is nervous he'll show up at the funeral. If he's such a mental case, that he needed a special cell, wouldn't somebody think he was a little risky to let out so soon after the incident?

Just my opinion: this is a case of white male privledge & family influence. I have talked to lots of people who knew this guy... this family... the stories are horrendous about John's violent temper. The family was afraid that he was going to show up at the funeral, from what I heard.

If this guy gets off for doing this to his wife... to his children... I've lost my faith in the judicial sytem in this county.

Stacey Larkin lived & breathed for her children. The last Facebook post she wrote was about how she was letting her children stay up later than usual, the night before she was murdered, in order to let her children make mini-snowmen with the season's first snowfall. This is the last memory those poor children will have of their mother.

Wrong.... so wrong.... on many levels!!! At least her murderer should spend the rest of his life in jail. I hope the older children are strong enough to testify, to assure justice for their mother.

I know several women who knew Stacey personally & they have ALL said that she would NEVER kill herself & leave her children with John. Ever! It is rumored that she even told some of her friends that she feared John would kill her. These friends need to come forward & testify in the trial. Maybe they will.

I heard the kids had a sleepover one night & Stacey went to go get McDonald's. When she got home, John's fries weren't in the bag & he went on such a rampage about it that the children who were sleeping over had to call their parents to come get them because they were so upset by John's behavior. These parents need to be found to testify also, if this is true.

Excellent post. What I find appalling is A) the husband tried to pass it off as an "accident" and the stupid officials saying "this is the evidence we have at this point." Why - because the guy who murdered his wife told you that?

My hope is he finds a lot of love in prison.

I appreciate the information. Like I said, I don't know the family or the situation at all, I was just trying to make sense of the statements made connected to this shooting.

True story. One of my college roommates was killed by a drunk driver who was doing 90 MPH down some state highway after having a ton of booze at a wedding. The guy got his sportscar under my buddy's tailend, flipped it over, and broke both his and his best friends necks on impact. The guy was a lawyer from PA, and had made bail and was out of the state within 48 hours. I don't know that I have ever been that angry.

Since he is out of Jail and free and Stacey cannot defend herself since she is dead, he is busy badmouthing her all over town saying all kinds of terrible things about her. The Marquete High School and Notre Dame School District "protective society" will do all that they can to help Johnny. She will be put on trial, not him.

I just discovered that the trial date has been set for some time in October. Of course, all these things go, there may be continuances. It shouldn't make any difference for Johnny; he is still out in the community telling his side of the story.

Whatever happened to this dog ear? I have heard that he has spent many months strolling around the neighborhood where he killed his wife. I hope that this is not yet another case where the county's lawyers have cut a deal behind closed doors. I also hope the local "media" has not gotten the word to keep quiet about what has been going on over in LaPorte on this case.

But wait, there is more. Larkin has now filed a law suit seeking "damages." The Long Beach cops really screwed up this case. This dog-ear may walk, and recover money in a civil suit.

Accused killer John Larkin of Long Beach is filing a lawsuit against LaPorte County for allegedly listening in on his private conversations with his attorney, and was holding back evidence that could prove his innocence. This is the second time an accusation of listening in on attorney client conversations has surfaced in LaPorte County, the last setting free accused murderer Brian Taylor during the summer.

Police Standards are broken. Doctors and Lawyers require a license. Police who are allowed to use deadly force do not have to have special licensing or certification. Many Police forces are less then 10 officers.

This article states that if the Medical profession still operated as police departments did they would still be using leaches. Law enforcement is a local matter. States may or may not mandate training standards. There is a national problem and better training supervision and licensing can help. It will cost more though.

One of the problems with the MC police seems to be in understanding how the law works. Listening in on privileged lawyer client conversations is a sure way to get that evidence thrown out. It is a stupid move and I understand they have contaminated other crimes as well. This is what a lack of training does. They may have gotten a good arrest but then contaminated the evidence so badly that it will be thrown out.

This places the prosecutor in a bad situation and he /she is forced to plea bargain from a bad position. Too bad, this is not how the justice system is supposed to work.

Heads should be rolling at both police departments and the prosecutors office. This absolutely cannot happen. It has now happened twice in a short period of time, that we know of.

I truly expected to see the story about the Larkin civil rights violations produce a whole lot more angry responses about this being the potential second violation of civil rights locally, in a very short period of time. When Taylor was released, one of the big questions I had was if this was a regular occurrence, or a one time mistake. Hearing now about a potential second happening of people listening into private conversations between attorney and client really scares me that we have a pattern going on now, and that this has happened more than twice. I feel that people should really be outraged about this. We have one allegedly confessed killer free already, and now another instance where the case could possibly be effected. This is incredibly serious here. The implications for us all are scary. I made the comparison the other day, but will make it again, people should be WAY more upset about this, than about an idiotic article about basketball in LaCrosse. There should be outrage and calls for investigations. More than anything we the public are due some answers to know that the legal justice system in LaPorte County is sound, and that our very basic civil rights, as promised by the constitution are being protected, and not regularly violated.

I would like to know how this guy can be paying for all these attorney's, I heard he is not working so to have multiple defense and civil lawsuit attorney's can not be cheap. Just make's me wonder where all his $$$ are coming from.

I don't know about anyone else but I am getting really tired of all the extensions and BS that John and his attorney's are pulling. If you think there is secrecy in the police department, try the courts! You have to be a member of the bar to get a code for the database. You can request from the Clerk, but you'll have to pay and if the Clerk objects, you have to go see a judge to get them released to you (and you have to have a good reason - that's how the TV shows get them.)

As far as I can tell, the Hon. Mary Harper has been appointed, Circuit Court Judge of Porter County. Judge Harper gave an interview here http://indianacourts.us/times/2012/07/hon-mary-r-harper-hon-david-l-chidester/

So, Larkin has been able to get all Laporte County judges recused and move the venue - as planned. This takes the case away from our community and deprives the Laporte County citizenry of adjudicating one of its citizens accused of a felony. You cannot believe how rare this is in Indiana - it's like < 0.1% likely, though perhaps more prevalent in "death" cases, but almost exclusively for murder. Never, and I mean never, for manslaughter.

For those who thought that voting Republicans into county offices (like judges and prosecutor) would change the system, you are horribly wrong. The system prevails! These guys have no guts at all. Let's see if this wisdom proves better applied on the council. This case is obvious radioactive. (I've been getting some funny looks, too, btw.)

"Following the money" is tough - but think about it - 2nd set of lawyers for the felony and the appeals, a set for the custody battle, a set as plaintiff, another for the feds and another for the insurance case - it' adding up. I have to believe that her own insurance money, the house, the kids' educations, anything they had before - it's all gone, so he can walk around free for the last four years. As a neighbor put it to me, "I hope he enjoyed it."

Believe me I have been following this on the court docket for a long time,I just hope the new Judge Hon. Harper will accept the case and be a firm stern Judge and finally get this going to trial as soon as she can. But like I have stated before I hope it is done right and he pays for what he has put Stacey's family through,the neighborhood through and his children will finally know the truth and he is a BSer. I think he has been free way to long.

Well it looks like the Judge in Porter County did not take the case,now on to Judge from Pulaski County. I sure do hope this Judge will accept the case and finally start the proceedings for Justice for Stacey and her family. This POS has been walking around free for way to long and it's about time he pays for what he did.

I too am alarmed by this. It goes beyond incompetence and the citizens should really be outraged into action.

I called Mike Bohacek to inquiry as to the information available out of the clerk's office and the inner workings of the clerk's office. Though Mike was helpful, he also said, "I can't get sucked into this." I took this to mean that the judiciary in Laporte County was the third rail of county government.

I called the DOJ and it is true that all court operations are guide by state law, but just try to read them. It is super complicated and I honestly was dizzy just trying to find out how files move after a court decision. Try it - and let me know if you can actually follow the chain of custody - it is beyond mind boggling. In any case, the County Board wants nothing to do with the judiciary, so you have to go to Indianapolis for any change - and it ain't easy. Just look at what Tom Dermody tried (and failed) to do with the property tax issue and the DLGF - no wonder he retired.

The appeals court doc is public and anyone can read it. I was looking to see if there were specific instructions regarding the court doc of the 12 minutes. There wasn't any concerning the file itself. May need help here as I am a complete amateur.

1. The county prosecutors office did not have to appoint a special prosecutor because Z had been voted out, there was no way Neary and his crew would continue and Espar was free and clear of entanglements (or was he? - more later). The point to bar Z was moot.

So why then did Espar appoint a special prosecutor, Stanley Levco, from downstate, to try the case when he didn't have to? The family did agreed to this. It should be noted that Levco is the SP in a court case in Porter County - the felony strangulation and domestic battery charged against Lake County Councilman Jamal Washington. This also involves a martial case and a change of venue - described as a nightmare for everybody. (I will look around for Levco stuff later, but suffice to say he is having a pretty good pay day in NWI and will for the foreseeable future!)

I care about civil rights. However, I care about the civil right to life more than I care about the right to defense lawyers that use every tactic under the sun to delay, cry foul, and generally muddy the waters.

I care about civil rights. However, I care about the civil right to life more than I care about the right to defense lawyers that use every tactic under the sun to delay, cry foul, and generally muddy the waters.

Ok here is an update from what I know on the case there were quite of few motions filed and gone over, there will be another attorney only meeting in Pulaski county court on May 11th. This is to go over any evidence that should or should not be allowed and also to go over the witness lists both attorney's have.

Then there is another pre-trial hearing scheduled for June 3rd in Pulaski county at 11:00 am there time.

There is still a chance this SOB can walk to due his attorneys saying his civil rights were violated.

As of now jury trial is scheduled to start June 20th in the Laporte county courts.

And here's a good one for you the SOB attorneys asked the Judge to ease his ban on travel restrictions so he can go see his mother in Grand Beach LOL we all know he has been going there for a long time what a joke.

I knew Stacey really well and I am close with the family, I know they can use anyone's support and if your voices could be heard. I think if anyone could support them in any of the court's it would be greatly appreciated.

Seems pretty open and shut to me. I believe the forensics show that the second shot was from at least five feet away with her sitting against the wall and him standing at the closet door with the gun. How do you explain away THAT!

I know they are so fed up with all the dragging on that has gone on for the last 3 1/2 years. I hope people speak up and really say how he was such a POS. Franklin you are 100% correct,did Stacey have a chance to voice her rights when he decided to take her life !!! When you consider the time that has elapsed between the commission of this crime and the actual trial I have no doubt that Mr. Larkin will raise the issue that his 6th amendment rights have been violated.

Speedy Trial

The Sixth Amendment to the U.S. Constitution guarantees all persons accused of criminal wrongdoing the right to a speedy trial. Although this right is derived from the federal Constitution, it has been made applicable to state criminal proceedings through the U.S. Supreme Court's interpretation of the due process and Equal Protection Clauses of the Fourteenth Amendment.

The right to a speedy trial is an ancient liberty. During the reign of henry ii (1154–1189), the English Crown promulgated the Assize of Clarendon, a legal code comprised of 22 articles, one of which promised speedy justice to all litigants. In 1215 the Magna Charta prohibited the king from delaying justice to any person in the realm. Several of the charters of the American colonies protected the right to a speedy trial, as did most of the constitutions of the original 13 states.

The Founding Fathers intended the Speedy Trial Clause to serve two purposes. First, they sought to prevent defendants from languishing in jail for an indefinite period before trial. Pre-trial incarceration is a deprivation of liberty no less serious than post-conviction imprisonment. In some cases pretrial incarceration may be more serious because public scrutiny is often heightened, employment is commonly interrupted, financial resources are diminished, family relations are strained, and innocent persons are forced to suffer prolonged injury to reputation.

Second, the Founding Fathers sought to ensure a defendant's right to a fair trial. The longer the commencement of trial is postponed, the more likely it is that witnesses will disappear, memories will fade, and evidence will be lost or destroyed. Of course, both the prosecution and the defense are threatened by these dangers, but only the defendant's life, liberty, and property are at stake in a criminal proceeding.

The right to a speedy trial does not apply to every stage of a criminal case. It arises only after a person has been arrested, indicted, or otherwise formally accused of a crime by the government. Before the point of formal accusation, the government is under no Sixth Amendment obligation to investigate, accuse, or prosecute a defendant within a specific amount of time.


The U.S. Supreme Court has declined to draw a bright line separating permissible pre-trial delays from delays that are impermissibly excessive. Instead, the Court has developed a Balancing test in which the length of delay is just one factor to be considered when evaluating the merits of a speedy trial claim. The other factors to be considered by a court include the reason for the delay, the severity of prejudice suffered by the defendant from the delay, and the stage during the criminal proceedings at which the defendant asserted the right to a speedy trial.

A delay of at least one year in bringing a defendant to trial following arrest will trigger a presumption that the Sixth Amendment has been violated, with the level of judicial scrutiny increasing in direct proportion to the length of delay. A longer delay may be deemed constitutional, however, and a shorter delay may be deemed unconstitutional, depending on the circumstances.

Longer delays will be permitted to accommodate the schedules of important witnesses, and to allow the prosecution to prepare for a complex case. Longer delays will also be tolerated when a defendant is dilatory in asserting the right to a speedy trial. In general, defendants must assert their Sixth Amendment right in a timely motion before the trial court. If the defendant fails to assert the right in this manner or acquiesces in the face of protracted pretrial delays, she or he may not raise the issue for the first time on appeal, unless the defendant's failure to raise the issue earlier was due to her or his attorney's Negligence. Defendants who delay prosecution by inundating the trial court with frivolous pretrial motions are also treated as having forfeited their rights to a speedy trial. The law does not allow defendants to profit from their own wrong under these circumstances.

Delays shorter than a year will be ruled unconstitutional if the reason for delay offered by the prosecution is unpersuasive or inappropriate. Delays attributable to prosecutorial misconduct, such as the deliberate attempt by the government to delay a proceeding and hamper the defense, will run afoul of the Speedy Trial Clause. Prosecutorial negligence, such as misplacing a defendant's file or losing incriminating evidence, is also considered an inappropriate reason for delay. Additionally, delays shorter than a year will be deemed unconstitutional when the delay has severely limited the opportunity for the accused to defend himself. For example, the death of an alibi witness who would have been available for a timely trial is considered Prima Facie evidence of prejudice under the Speedy Trial Clause.

Despite the strictures of the Speedy Trial Clause, criminal justice has not always moved swiftly in the United States. During the 1970s federal courts had backlogs of thousands of cases on their dockets. Lengthy pretrial delays clogged local jails at great expense to taxpayers. Increasing numbers of defendants were jumping bail while free during extended pretrial release. In 1974 Congress enacted the Speedy Trial Act (18 U.S.C.A. §§ 3161 et seq.) to ameliorate the situation.

Unlike the balancing test created by the Supreme Court to evaluate a claim under the Speedy Trial Clause, the Speedy Trial Act establishes specific time limits between various stages of federal criminal proceedings. The act requires federal authorities to file an information or indictment within 30 days of a defendant's arrest. A prosecutor who knows that an accused is incarcerated at the time of indictment must take immediate steps to initiate prosecution. If a defendant enters a plea of not guilty, trial must commence within 70 days from the filing of the information or indictment or 70 days from the first appearance of the accused in court, whichever is later.

Certain types of delays are exempted from the act's time limitations. For example, the act exempts delays caused by the absence of the defendant, the unavailability of an essential witness, or the conduct of a codefendant. Delays resulting from a defendant's involvement in other legal proceedings are typically exempted as well. Additionally, the act gives courts discretion to grant the prosecution a Continuance in the interests of justice. Courts are also given discretion to dismiss charges when a defendant suffers prejudice from a pretrial delay that is of a kind not exempted under the act.

The Speedy Trial Act has been held to apply to both citizens and non-citizens alike. See United States v. Restrepo, 59 F. Supp. 2d 133 (D. Mass. 1999). However, since the September 11th Attacks in 2001, the United States has sought to enhance the abilities of immigration officials and other law enforcement officers to prevent further terrorist attacks. Under the USA PATRIOT Act of 2001, Pub. L. No. 107-56, 115 Stat. 272, the attorney general may certify a non-citizen as a terrorist if reasonable grounds exist to believe that the non-citizen has been engaged in terrorist activities. If the attorney general certifies the non-citizen as a terrorist, the act mandates the detention of the non-citizen. If the terrorist is deemed to be a threat to national security, or if emergency or other extraordinary circumstances are present, the federal government may detain the person for six months or longer. Accordingly, a suspected terrorist could be detained for a significant period of time without criminal charges or deportation proceedings brought against the suspect.

Many state jurisdictions have passed legislation similar to the Speedy Trial Act. Like the federal act, most state legislation permits courts to provide prosecutors with additional time upon a showing of exceptional circumstances. Most state laws also authorize courts to dismiss charges that have not been brought within a reasonable amount of time following arrest or indictment. Thus, these defendants faced with an unreasonable pretrial delay have a number of constitutional and statutory provisions that may provide them with effective relie

It is official Judge from Pulaski County dismissed the case, the family found out today. Now Long Beach has a killer walking around, trashing Stacey's memory and her family.

it is done. Judge Blankenship of Pulaski County Indiana has dismissed the case against John Larkin in the death of Stacey Simon. He can dismiss whatever charges he wants, but it won’t change the fact that John shot Stacey twice during a heated argument. Stacey’s life was lost and John walks away from all of this a free man. He is and always will be a murderer. May Karma kick you in the ass, John Larkin.

The joke of the matter is that the motion that he dismissed this on is the CR4, a timeframe of the proceedings. The judge is saying that the State failed to provide John with a fair and speedy trial. They are saying that the State had 90 days from the time the appeal came back to get him tried, and that did not happen. What a joke!

In all of the hearings that we sat through and all the arguing we heard from both sides, we never heard about what crime John committed. We only heard about what others did that was wrong… the police, the investigators, the prosecutors, etc. I think that is what is so angering about all of this. John never had to face the crime he committed in court.

Thank you to everyone who has supported the family, the fact that a Mother lost her daughter, a brother lost his sister, the family lost a niece, cousin, god mother doesn't seem to matter to the Judge's that all recused themselves, and this Judge Blankenship didn't seem to take the family into consideration. I pray none of you ever have to go through what we have the past 3 1/2 years.

As one of the closet relatives of Stacey I can tell you I am disgusted and so is my family on how this has turned out,yes there may have been some speed bumps in the process. But to dimiss this case on grounds of a CR-4 motion is crazy.

Let's look into all the delay's the SOB and his attorney's have made,from asking for extension after extension to asking for judges to reculse themselves, delay after delay as we the family have waited for 3 1/2 years for some justice to be done. But NO now this POS gets to say he is a free man well in my eyes this is bullshit. I hope that some day we go to Appeals court and he will sit in front of a jury and have to look at the photos that we saw of Stacey lying there with 2 bullet holes in her body YES 2. I can only says that you, your family, Stacey and Stacey's friends were horribly wronged during by the travesty that is the Indiana judicial system. John may be pleased that he finally found a judge who would let him go on what are misrepresented technicalities. If John is ever (God willing) judged on the merits[i] of the case he will either be in prison or in hell. I for one hope that judgement day will come right swift.

He even seems to be lending a hand in the civil case by determining that the law enforcement agency "did everything in their power to intentionally violate this Defendant's constitutional rights and civil rights, and make it as difficult as possible for him to obtain a speedy trial".

Out on $10,000 bond for close to four years, living the high life at home with the kids, trying to set up shady real estate transactions with the kids' estates to get to the money, requesting recusal after recusal of judges and filing an interlocutory appeal moments before the trial was scheduled to start and which appeal was denied by the appellate court. Sounds like the poor kid was desperate to have a speedy trial.

Stacey sure got a speedy death but this chickensh&t judge just can't believe how poorly the shooter was treated.

If there's a God, there must be an appeal to this gross incompetence!

I disagree with this totally. He just took advantage of the cards he was played, which is exactly what any lawyer worth a penny would have done. Brian Taylor's lawyer did the exact game thing, to almost the exact same result. Now if the County and local agencies hadn't have handed him this gift on a platter, none of the delays would have happened. There would have been no reason for it.

It sucks that it happened, as he Larkin should have stood trial so that the legal process could truly determine guilt. But we all have civil rights, that can't be negotiated. The tragedy of this case is the "clown car actions" of the justice / legal system. Any competent judge and attorney knows that there is a Constitutional mandate for the right to a "speedy trial." Allowing this case to be constantly transferred, judges recusing and the overall treatment of this case by the system is the where the fault lies.

The result of these maneuverings is that this trial will never proceed on the merits of the case. This could have been a terrorist attack or a wicked First degree murder trial. It was only being pursued as a 3rd degree manslaughter case but the result is the same. There will never be a review of the facts and the merits of the case and this man cannot be tried.

As in the O.J. trial there could be a civil case however considering the long time that the criminal trial has taken if they have not already filed then it is too late. There is no statute of limitations on murder but there is a definite one on civil damages arising out of a criminal case. If it has not already been filed it is probably too late.

I'm really not a conspiracy theorist but after reading Blankenship's opinion, I have to think that someone is on the take here or attempting to bolster the numerous civil cases being brought by the killer.

The original trial court noted that, regarding the accidentally (the defense attorney even admitted that it was not intentional) recorded 10 minute BS session with his attorney "this conversation did not prejudice Defendant to the extent that charges must be dismissed. Although the actions of law enforcement and the Prosecutor’s Office were careless, none of the aggrieved behaviors were intentional."

Also, Blankenship does not mention that there was never a cognizable request for an attorney. By just saying "talk to Bob" or "Bob will tell you...), no officer should be accused of being unscrupulous for simply not understanding who the hell the rambling, can't-shut-his-mouth-to-save-his-life person in question is referring to! At that point in time he hadn't even been charged with a crime, for god's sake!

This judge just showed us clearly that the criminal is more important than the victim in our justice system. Sick, sick, sick!!!

With all due respect, you have no grasp where my "sympathies" lie if you feel that way. My "sympathies" lie with people who kill others going on trial. Because of all of the delays and motion that came out of the stupid act of violating Larkin's civil rights (again, and Brian Taylor's) this door got opened to Larkin (and Taylor). Larkin has a legal right to get the items heard, and it isn't his fault they happened. If the authorities don't open this door, Larkin isn't able to use it.

And if you want to make this a rich thing, please explain to me how poor and black Brian Taylor ended up back on the street in a similar situation? In fact, poor and black Brian Taylor saw the authorities essentially drop the case until they can find other outside and non-compromised evidence. Rich and white Larkin saw much more of a courtroom than Taylor did.

I know your point of view is compromised by your close position to this case. But realistically, this case has long since been to trial if the violation of civil rights didn't happen. Even if it didn't give the direct reason for the dismissal, that violation was the direct cause of the dismissal. Literally it all traces back to that.

I work with court systems in St. Joseph, Elkhart and Marshall counties and see suspects walk quite routinely because something was not "done by the book." In St. Joseph County suspects are routinely released because of over crowding in the jails - you are only allowed to hold a suspect for so long without charging them. Elkhart County use to use a school bus to take suspects to jail which is against the law so charges get dropped. Marshall County has trouble documenting crime scene evidence, records, and questions simply because they don't deal with homicides often.

I sympathize with victims families, but we don't want to a third world justice system either.

I know from myself I am so pissed off that this man is walking free telling so many bad things about Stacey and our family just is not right.

I'll bet at least 10-1 odds that the decision is overturned and remanded. The ultimate issue will be that there should be a new judge who actually follows the decisions of the appellate court. This judge's disregard of appellate decisions and previous orders of the trail judge are simply stunning. An emergency hearing without allowing the state to file a response??? What do they have on the guy? It might be worth a national network's time to poke around here.

Looks like the Attorney General has asked for an extension on the SOB appeal. The Chief Judge has granted it the y have until Oct. 3rd to file papers. I am totally fine with the AG asking for the extension. Hell the POS and his attorney's asked how many times over the last 3 3/4 years. I don't care how long it takes now as long as the ruling gets overturned and the POS goes to trial.

A judge has already determined that she is clearly not working in the interest of the kids. It would be bizarre for another judge to decide that she's changed her stripes. Truly sad but it's all about $$$.

Looks like the appeal is in the courts hands the Attorney General asked for a minor extension to file some things, I am totally fine waiting, if it takes another 6 months or more what's the big deal. As long as it gets overturned and the POS SOB sits in front of a jury that's what matters.

The case is in the Appellate courts now , I am hoping the Judges make the right decision to overturn the ruling and send it to trial.

I hope the case goes to trial and the SOB POS goes to jail !!!!

Looks like the Appellate Court gave the SOB attorneys only till January 9th to file their response to the Attorney General briefing why this case should be turned over and sent back to trial. Poor Johnny's attorney poured his life story out why it they should get longer sorry I don't care about your knee surgery and everything else going on in your life, but the Appellate court won't let them GOOD !!. Stacey didn't get a choice that night to live or die, the POS made that decision for her. I hope the Appellate court makes the right choice for Justice and overturns the decision and sends his HAPPY ASS TO TRIAL.

Just some info for everyone, the SOB has hired another attorney I will bet they will try to get another extension on this, I really hope the Appellate court tells them no and decides to over turn the ruling faster. And send this murderer POS to trial then find him guilty and let his ass rot in jail for a while. They're doing everything they can to muddy the waters. He and his attorneys did everything they could to delay the trial (and this appeal). He actually said that they're going to do everything possible to make the cops look bad even though he was friends with one of them. I hope the appeal judges are smart enough to see through his crap. The trial judge wouldn't even let the State respond to his decision that was based on a very thin understanding of the facts which he took, almost entirely verbatim, from the defense attorneys. Justice must win out!

Rumor was to take a different job, all I have to say is GOODBYE thanks for letting the POS free for now. I hope that now the Appellate court has to make their decision I pray the realize that Judge Blankenship was wrong and they overrule his ruling.

So after 4 1/2 years of my family dealing with the POS JOHN LARKIN killing my wonderful sister Stacey Simon Larkin. The appellate court did not overturn the ruling so that means that there is a killer roaming the streets in Long Beach Indiana. I am so disappointed in the justice system the has let our family go through this heartache and pain for so long and not bringing this POS SOB to trial or justice. He may be a free man but he has to live with the thought of knowing that he killed my sister, my mom and dad's daughter, aunts and uncles niece & cousin's and his children's mother. That is two killers that are out on the street due to our justice systems failings locally. Both of them are free people because our legal teams were listening in on privileged conversations.

The Supreme Court over turned the dismissal and is sending this case to trial. I read in the New Dispatch article that "the Larkin Family are disappointed and they are going to fight until justice is done and John and the children can heal and move on"

It seems that in the past 51/2 years they have moved on quite well there is no memory of Stacey, Her family are the ones that need time to heal and be able to move on with their lives, they have been putting everything on hold to see Justice done for Stacey.

They can say what they want but the fact remains that Johnny boy killed his wife, she was shot twice, he is claiming it was an accident, she turned the gun on herself how on earth do you shoot yourself twice in two different areas of the body accidentally?

I would like the public to know that the grandmother of Stacey's children (Stacey mom), who did everything for those children while living out by Stacey, never was allowed to see the grandchildren after all this happened. Now John ( in his oh I did nothing wrong voice and face)will tell people he never forbid the grandma to see her but I know for a fact he did, along with Stacey's brother and his wife along with other family from Stacey's side. Looks like trial date will be scheduled for September 9-13 2019. It will be in Laporte County. When and if it does go to trial it will be over 6 1/2 years that the POS has been free. I hope the residents of Long Beach and surrounding areas remember what this MONSTER did to Stacey.

Just wanted to say this is the 6th anniversary that the POS took Stacey's life and he is still walking around a free man. She did not deserve to have her life taken by such a Fu**ing coward. I hope you feel good about yourself ASSHO**. Till this day he or the children have never been to the cemetery, kids were the day of her funeral but not since. I will put money on it they even don't know where it's located or could even find Stacey's grave, I think he has brainwashed them so bad they have forgotten about her. I just saw someone who heard that he was setting up a Go Fund Me page so that he can keep the $$$ and not worry about the lawyer fees. Now that's chutzpa!

Well it was more a hearing on them trying to get it dismissed again, court lasted 3 1/2 hours. It was the biggest BS saying everything the State did was wrong. Now waiting on Judge Bradford decision.

I hear there's an investigative report in the works. They are interested in why Indiana has such a hard time trying a man who shot an unarmed woman. TWICE! The stuff on that corrupt judge will be a great side line.

Just some information for you back to Porter County for a status hearing this Thursday the 15th. Trial is scheduled to start Sept. 9- 13 . It will be back in either Laporte county or Michigan city. Once I know I will post it here.

The trial will be in Michigan City Superior court 1 Judge Berguson court.
