Cell-phone Towers May Be Regulated In TC

TRAIL CREEK - The Trail Creek Town Council is considering an ordinance that would regulate cell phone towers.

Council attorney William Herrbach said municipalities have recently been given more control over where cell towers can be built.

"There's been some movement regarding cell towers in the state of Indiana. The theory in the past is that cell towers were pretty well regulated by state control and federal control," said Herrbach.

"Municipalities had very little control. There's been some court cases this year that have given more of the control back to the towns and the city, at least for public safety and aesthetics," he said.

Herrbach proposed putting together an ordinance regulating cell towers that would give the town as much control as possible regarding where towers go and what they look like.

"We can't preclude them all together. We can regulate where they do go," Herrbach said.

The tower industry, said Herrbach, is going into what's called Phase Three which means there will be more towers.

"There's going to be more and more towers," Herrbach said. "They're not going to be as tall as they are now."

Sounds reasonable to have some local control.
