La Porte County Sheriff's Office
The La Porte County Sheriff's Department is on the scene of a homicide investigation in the 6700 E. Block of CR 1000 North in Hudson Township. Preliminary investigation shows that a burglary had occurred at the residence as well. The sheriffs department detective bureau is on the scene and will have more information shortly.

LAPORTE COUNTY | A man who allegedly broke into a home in northern LaPorte County Monday morning was shot dead by the property owner.

LaPorte County Sheriff Mike Mollenhauer said the body of the shooting victim was still inside the residence two hours after officers first responded.

Just after 9 a.m., numerous officers descended upon a log home in the 6700 block of East County Road 1000 North a few miles west of Hudson Lake and just east of the Maple Grove United Methodist Church.

The names of the victim and property owner were not immediately released but Mollenhauer said the alleged burglar was in his 20s and from Michigan.

The homeowner was taken to the LaPorte County Sheriff's Office for further questioning.

Due to the ongoing investigation, Mollenhauer would not talk about the circumstances leading up to the shooting except to say after the break-in the homeowner encountered the intruder, who was fatally shot inside the single-story home.

He also said the chain of events as told by the homeowner seems to match the evidence collected at the crime scene on how the shooting took place.

"I don't anticipate there would by any charges whatsoever," said Mollenhauer.

The home where the shooting occurred sits about 100 feet off the edge of the roadway and is difficult to see from the road due to a dense woods and thick brush.

Mollenhauer said a heavy cover is what attracts burglars so they are not seen by passersby.

"This is what they look for, is places that can't be very visible from the road. As you can see this one is not visible from the road except for just a driveway," said Mollenhauer.

Mollenhauer would not say how the suspect entered the home. He said no one else was inside the home prior to the burglary except for the homeowner.

On Monday, July 8, 2013 at approximately 9:15 CST, the La Porte County Regional 911 Dispatch Center received a 911 call from a homeowner who reported that his home had just been burglarized and he had shot the intruder. Deputies from the La Porte County Sheriff’s Office were immediately dispatched to the residence, which is located in the 6700 East block of County Road 1000 North.

Upon arrival deputies located the suspect in the home, deceased from a single gunshot wound to the chest. Investigators have learned that the homeowner was in his home sleeping when he was awakened to the sound of breaking glass. He armed himself with a pistol and began to investigate the noise and found a single intruder in his home. The suspect was armed with a hatchet and after a physical confrontation, the suspect was shot by the homeowner. The homeowner then immediately called 911. The homeowner was checked by La Porte County Emergency Medical Service personnel but he declined further treatment.

Investigators have determined that the suspect entered the home via a rear window that he had shattered. It is believed that he arrived at the home of the victim by moped and the victim did not know the suspect. It is believed that the suspect resides in Three Oaks Township, Michigan and he has yet to be identified pending notification of next of kin.

Investigators from the Sheriff’s Office remain on scene and continue to investigate this incident.

The public is encouraged to contact lead investigator Detective Andy Hynek at (219) 326-7700 ext. 2401 should they have additional information about this or similar offenses.

He said an official decision will be made once the investigation is completed, but he doesn't expect any evidence to surface that would change what they believe occurred leading up to the shooting.

Jason Rabe, 23, of Three Oaks, was pronounced dead from a single gunshot wound to the left side of his upper chest inside a log home in the 6700 block of E. County Road 1000 North. The rural area in northern LaPorte County with its dense woods and rolling hills is attractive to second homeowners.

LaPorte County Sheriff Mike Mollenhauer said the man renting the home told investigators he was awakened Monday about 9 a.m. by the sound of breaking glass.

He grabbed his pistol and encountered the intruder holding a hatchet in a utility room, police said.

Szilagyi said Rabe was asked to drop the hatchet but refused then during a physical struggle for the gun he was shot. The body was located in the living room, authorities said

Szilagyi said both the intruder and burglary victim had scratch marks on their faces that substantiated there was some type of physical altercation.

Mollenhauer said the investigation shows Rabe threatened the resident with the hatchet but doesn't believe he actually took a swipe at him with the blade.

The La Porte County Sheriff’s Office has announced that the investigation concerning the July 8, 2013 residential burglary and shooting death that occurred in the 6700 East block of County Road 1000 North has been closed with no charges being filed.

Investigators from the Sheriff’s Office recently completed their investigation into the events surrounding the burglary and shooting and tendered their findings to the La Porte County Prosecuting Attorney’s Office. After reviewing the investigative reports and evidence summary, La Porte County Prosecuting Attorney Robert Szilagyi concluded that the victim, Stephen Penny, acted in self-defense when he shot Jason RABE and therefore his office will take no further action. The investigation revealed that RABE had broken into the home of Penny and the two struggled when Penny acted in self-defense and shot RABE once in the chest. RABE was pronounced dead at the scene from a single gunshot wound to the chest.

Based upon the findings of this investigation as well as the determination of the La Porte County Prosecuting Attorney’s Office, the La Porte County Sheriff’s Office has closed this investigation
