Full Version: Possible Fatal Shooting in Long Beach?

As one of the closet relatives of Stacey I can tell you I am disgusted and so is my family on how this has turned out,yes there may have been some speed bumps in the process. But to dimiss this case on grounds of a CR-4 motion is crazy.

Let's look into all the delay's the SOB and his attorney's have made,from asking for extension after extension to asking for judges to reculse themselves, delay after delay as we the family have waited for 3 1/2 years for some justice to be done. But NO now this POS gets to say he is a free man well in my eyes this is bullshit. I hope that some day we go to Appeals court and he will sit in front of a jury and have to look at the photos that we saw of Stacey lying there with 2 bullet holes in her body YES 2. And the blood that covered her and this POS has no remorse did he ever try to contact myself or anyone in the family NO !!!.

When I stood there at Stacey's funeral and the POS family comes up to me and says is so sad that drugs and alcohol were involved, I say to them kiss my ass Larkin family and all your nose pointed up in the air friends. May you have a shitty rest of your lives. Telling everyone your poor Johnny did nothing wrong BULLSHIT ! He pulled the trigger on the gun did he stop after the first shot and think to himself what did I do NO he fires a second shot into the mother of his children. And then leaves her in the closet to DIE !!! He doesn't have the balls to try to help her or sit by her body no, he probaly started calling his family to say what he did to try to get the ball rolling for his defense.

This will not be my last rant about the POS SOB no it won't.

I ask the residents of Long Beach and the surrounding communities to let there voices be heard,let the politicians know how out raged the family and yourselfs are. Let people know that there is a MURDERER living at 2913 Lothair Way Long Beach In. Yes let people know !!!!!.

On behalf of myself and my family we thank everyone who has stood by us from the beginning of this tragic event and still stands with us. Until hopefully justice will be served.

I can only says that you, your family, Stacey and Stacey's friends were horribly wronged during by the travesty that is the Indiana judicial system. John may be pleased that he finally found a judge who would let him go on what are misrepresented technicalities. If John is ever (God willing) judged on the merits[i] of the case he will either be in prison or in hell. I for one hope that judgement day will come right swift.

Being the one aunt Stacey talked to on a daily basis, we discussed many things that were wrong in the marriage,. One always being that John constantly threatened her by telling her that if she ever left him she would never see her children again well he actually made this happen but he had to kill her to do so.

Stacey was a giving, loving person. She was mentally abused by John and his mother I witnessed many degrading comments she endured from Karen Johnson. This woman walks around thinking she shits gold. She couldn't even keep a son from committing suicide, and has a daughter who is a drug addict and a granddaughter that attempted suicide.

Yes Judge Blankenship NEVER discussed why we were at the hearings for,. All he was considered about was what the Laporte county prosecutor did wrong. We hold on to the hope that Larkin will face the Attorney General and will serve his time. Always remember 2 people were in the closet that night one walked out,. Called 911 hung up, when the police tried to call back there was no answer because in my opinion he was on the phone with his family getting them out there to get his money line working.

You forgot to add that John's father John Sr. did time in a federal penitentiary for embezzling from the bank he worked at. It's fair to say that John comes from pretty sleazy stock.

Has anyone read Judge Blankenshitp's rambling and, at times, incoherent opinion? John could not have canvassed the country and hand selected a more sympathetic judge. This thing HAS to be appealed! There's no way that Judge Friendly's logic holds up under the scrutiny of the Indiana Appellate Court.

He even seems to be lending a hand in the civil case by determining that the law enforcement agency "did everything in their power to intentionally violate this Defendant's constitutional rights and civil rights, and make it as difficult as possible for him to obtain a speedy trial".

Out on $10,000 bond for close to four years, living the high life at home with the kids, trying to set up shady real estate transactions with the kids' estates to get to the money, requesting recusal after recusal of judges and filing an interlocutory appeal moments before the trial was scheduled to start and which appeal was denied by the appellate court. Sounds like the poor kid was desperate to have a speedy trial.

Stacey sure got a speedy death but this chickensh&t judge just can't believe how poorly the shooter was treated.

If there's a God, there must be an appeal to this gross incompetence!

I disagree with this totally. He just took advantage of the cards he was played, which is exactly what any lawyer worth a penny would have done. Brian Taylor's lawyer did the exact game thing, to almost the exact same result. Now if the County and local agencies hadn't have handed him this gift on a platter, none of the delays would have happened. There would have been no reason for it.

It sucks that it happened, as he Larkin should have stood trial so that the legal process could truly determine guilt. But we all have civil rights, that can't be negotiated. When those rights are violated, the legal system doesn't really have any other recourse than to determine the process in that case is tainted. Unfortunately the facts of the case are immaterial to those violations of civil rights. That is why the granting and following of an accused's rights are so vital. Two different people who killed someone else are on the street now because of it.

I completely understand and agree with the civil rights argument and believe that irresponsible prosecutors are negligently responsible for many future crimes committed against their "constituents".

I think that 20/20 or some local news outlet should be tipped off on how this played out and to let the public know the problems with some of the justice system.

I can not believe the rumors and the way he is talking about the family Stacey's family was not well to do like his but they are a great family that sticks together through thick and thin ,he is a very messed up and disturbed man that needs to go away for a long time. But now it's up to see what the prosecution and the AG wants to do.

The tragedy of this case is the "clown car actions" of the justice / legal system. Any competent judge and attorney knows that there is a Constitutional mandate for the right to a "speedy trial." Allowing this case to be constantly transferred, judges recusing and the overall treatment of this case by the system is the where the fault lies.

The result of these maneuverings is that this trial will never proceed on the merits of the case. This could have been a terrorist attack or a wicked First degree murder trial. It was only being pursued as a 3rd degree manslaughter case but the result is the same. There will never be a review of the facts and the merits of the case and this man cannot be tried.

As in the O.J. trial there could be a civil case however considering the long time that the criminal trial has taken if they have not already filed then it is too late. There is no statute of limitations on murder but there is a definite one on civil damages arising out of a criminal case. If it has not already been filed it is probably too late.

I'm really not a conspiracy theorist but after reading Blankenship's opinion, I have to think that someone is on the take here or attempting to bolster the numerous civil cases being brought by the killer.

The original trial court noted that, regarding the accidentally (the defense attorney even admitted that it was not intentional) recorded 10 minute BS session with his attorney "this conversation did not prejudice Defendant to the extent that charges must be dismissed. Although the actions of law enforcement and the Prosecutor’s Office were careless, none of the aggrieved behaviors were intentional."

Also, Blankenship does not mention that there was never a cognizable request for an attorney. By just saying "talk to Bob" or "Bob will tell you...), no officer should be accused of being unscrupulous for simply not understanding who the hell the rambling, can't-shut-his-mouth-to-save-his-life person in question is referring to! At that point in time he hadn't even been charged with a crime, for god's sake!

This judge just showed us clearly that the criminal is more important than the victim in our justice system. Sick, sick, sick!!!

We know where your sympathies lie with respect to the present case but you don't have a grasp on what is necessary to throw out a voluntary manslaughter charge. With all due respect, you have no grasp where my "sympathies" lie if you feel that way. My "sympathies" lie with people who kill others going on trial. Because of all of the delays and motion that came out of the stupid act of violating Larkin's civil rights (again, and Brian Taylor's) this door got opened to Larkin (and Taylor). Larkin has a legal right to get the items heard, and it isn't his fault they happened. If the authorities don't open this door, Larkin isn't able to use it.

And if you want to make this a rich thing, please explain to me how poor and black Brian Taylor ended up back on the street in a similar situation? In fact, poor and black Brian Taylor saw the authorities essentially drop the case until they can find other outside and non-compromised evidence. Rich and white Larkin saw much more of a courtroom than Taylor did.

I know your point of view is compromised by your close position to this case. But realistically, this case has long since been to trial if the violation of civil rights didn't happen. Even if it didn't give the direct reason for the dismissal, that violation was the direct cause of the dismissal. Literally it all traces back to that.

I agree with SouthSider on this issue. Civil liberties are a trump card in almost all situations. I work with court systems in St. Joseph, Elkhart and Marshall counties and see suspects walk quite routinely because something was not "done by the book." In St. Joseph County suspects are routinely released because of over crowding in the jails - you are only allowed to hold a suspect for so long without charging them. Elkhart County use to use a school bus to take suspects to jail which is against the law so charges get dropped. Marshall County has trouble documenting crime scene evidence, records, and questions simply because they don't deal with homicides often.

I sympathize with victims families, but we don't want to a third world justice system either.

I know we need a justice system and I know there are flaws sometime's,but when the Judge really did not even consider the victim's family who sat through hearing after hearing and just to hear oh how this and that was not done right.

I know from myself I am so pissed off that this man is walking free telling so many bad things about Stacey and our family just is not right.

I think the residents in the area are furious and should be concerned and worried, you know he has a temper and can go off anytime. Just remember the address 2913 Lothair Way he shot and killed someone.

Just third world gun violence, huh? I assume they're giving Mr. Larkin back his AK-47 and the rest of his guns. Go ahead and sympathize Outsider, I think that the family, and the community, would feel a whole lot safer with an unstable killer behind bars.

Well it looks like this has gone to the court of Appeals, let's hope for a good out come that it gets overturned and it goes to trial. Last time one of his Appeals took a long time but it was in favor of the prosecution.

I'll bet at least 10-1 odds that the decision is overturned and remanded. The ultimate issue will be that there should be a new judge who actually follows the decisions of the appellate court. This judge's disregard of appellate decisions and previous orders of the trail judge are simply stunning. An emergency hearing without allowing the state to file a response??? What do they have on the guy? It might be worth a national network's time to poke around here.

Well the SOB is in the hands of the Appelate court now,I pray they overturn the ruling by Judge Blankenship and send him to trial. He needs to see and hear what he did to remind him that he is a monster and a POS.

Looks like the Attorney General has asked for an extension on the SOB appeal. The Chief Judge has granted it the y have until Oct. 3rd to file papers. I am totally fine with the AG asking for the extension. Hell the POS and his attorney's asked how many times over the last 3 3/4 years. I don't care how long it takes now as long as the ruling gets overturned and the POS goes to trial.

Which I hope someone watches closely, I know as a family member if he touches the money there won't be anything left or little left for the kids. A judge has already determined that she is clearly not working in the interest of the kids. It would be bizarre for another judge to decide that she's changed her stripes. Truly sad but it's all about $$$.

Looks like the appeal is in the courts hands the Attorney General asked for a minor extension to file some things, I am totally fine waiting, if it takes another 6 months or more what's the big deal. As long as it gets overturned and the POS SOB sits in front of a jury that's what matters.

Has anyone heard anything lately on the appeal of the Stacy Simon Larkin Murder? I cannot believe that this has gone on for so long. Stacy's youngest Anne Shae just had a big birthday, her 13th.
I feel sad for all the children, Kate, Quinn, Cal and Anne. I hope that they are able and allowed to talk about their mom. She loved them so.

Please keep Stacy, her children and her family in your thoughts and prayers.
Stacy Simon was a mother, a daughter to Kathleen Simon, a sister to Scott Simon and a neice to 5 aunts and an uncle and cousins that miss her very much.

Stacy Simon was a mother, a daughter to Kathleen Simon, a sister to Scott Simon and a neice to 5 aunts and an uncle and cousins that miss her very much.


The case is in the Appellate courts now , I am hoping the Judges make the right decision to overturn the ruling and send it to trial.

I know the kids are not allowed to talk to Kathy (Grandma) or Scott and his wife Tracy. They forbid the kids to have any contact with them.

I hope the case goes to trial and the SOB POS goes to jail !!!!

Today is Stacey's oldest daughter Kate's 18th birthday, I am sure Stacey is looking down on her and thinking she is growing up to fast. I just want to let Kate know that we love her and we hope some day she will understand what the truth is that happened to her mother and what their father did. And we always keep all of our Nieces and nephew in our thoughts.

Looks like the Appellate Court gave the SOB attorneys only till January 9th to file their response to the Attorney General briefing why this case should be turned over and sent back to trial. Poor Johnny's attorney poured his life story out why it they should get longer sorry I don't care about your knee surgery and everything else going on in your life, but the Appellate court won't let them GOOD !!. Stacey didn't get a choice that night to live or die, the POS made that decision for her. I hope the Appellate court makes the right choice for Justice and overturns the decision and sends his HAPPY ASS TO TRIAL.

For those of you that are following the Appellate ruling on this case, if you have not read the motions filed for extension by the SOB attorney Foster, please do they will give you a good laugh the reasons he gives is hilarious. I don't need to know about his personal life, I surely hope the Appellate court looks at this joke and overturns the ruling and sends good old Johnny (SOB) to trial.

Just some info for everyone, the SOB has hired another attorney I will bet they will try to get another extension on this, I really hope the Appellate court tells them no and decides to over turn the ruling faster. And send this murderer POS to trial then find him guilty and let his ass rot in jail for a while. We as a family want some justice for Stacey and any other family who I hope does not have to go through all this BS .

Ok well the SOB attorneys have filed their brief to the Appellate court. So now is the waiting game to see what the courts decision will be let's all hope it goes in favor of Stacey .

They're doing everything they can to muddy the waters. He and his attorneys did everything they could to delay the trial (and this appeal). He actually said that they're going to do everything possible to make the cops look bad even though he was friends with one of them. I hope the appeal judges are smart enough to see through his crap. The trial judge wouldn't even let the State respond to his decision that was based on a very thin understanding of the facts which he took, almost entirely verbatim, from the defense attorneys. Justice must win out!

Well here's some information for you , Judge Blankenship the judge that dismissed the SOB POS case has resigned from his position in Pulaski county. Rumor was to take a different job, all I have to say is GOODBYE thanks for letting the POS free for now. I hope that now the Appellate court has to make their decision I pray the realize that Judge Blankenship was wrong and they overrule his ruling.

It's particularly interesting that he's moving to Florida to take a position in the traditionally corrupt waste management industry.

Unfortunately, I couldn't make it because of work. How was it? Did the judges ask questions?

Yes they change did ask questions, felt like one of the Judge's was for our side one ?? The last hard to feel out. The decision could take 2 weeks or 2 months. Just hope for the right choice to overturn and send the SOB POS to trial

So after 4 1/2 years of my family dealing with the POS JOHN LARKIN killing my wonderful sister Stacey Simon Larkin. The appellate court did not overturn the ruling so that means that there is a killer roaming the streets in Long Beach Indiana. I am so disappointed in the justice system the has let our family go through this heartache and pain for so long and not bringing this POS SOB to trial or justice. He may be a free man but he has to live with the thought of knowing that he killed my sister, my mom and dad's daughter, aunts and uncles niece & cousin's and his children's mother. I hope you fry in HELL YOU ASS****.
